  • Fiance Visa -/- Adjustment of status -/-Spouse Visa

    Hi Guys,
    Here is our case:
    Husband: US Citizen
    Wife: Indian Citizen with H1.

We had applied for our I-129 F (K-1 Not yet married - fiance), by filing all necessary forms in June first week. We received our NOA1 within a week and our case was sent to NSC. We had our wedding planned in India in August and got married in India. Husband went back to US and wife is awaiting an on-site opportunity scheduled in November.

Is there a separate document required to first stop the I129F process (which is still in March first week) before we start Adjustment of Status, when she gets here?

    Thank you for your time.
    Our Case:

I - Husband - Naturalized US Citizen based in East Coast.
Her - Wife - H1 - Working for an Indian MNC for a USA client based in West Coast.

Married recently in India according to Hindu traditions.

    Current Status - Preparing I 130 - I 485 - I 765 and other docs package for AOS for wife.

after her interview in india where she will still have to proof the marriage is genuine, telephone records, emails, photos, etc, when she gets to u.s you must marry her with 90days and file for her within that same 90days for her adjustment of status. my adjustment of status and work permit all took 4months. i file in may 24 got my work permit within 3months, and my two years green card yesterday.

      mmh!

From my understanding you can not marry before i129F has been approved... it will be denied and you will be advised to apply i130.
unless you decide not to tell them that you are already married at the interview in India she will need evidence of relationship like pictures of you two and you and othe family members of both sides (if possible) emails ,phone call Etc but not wedding pictures.
when she gets here you can Adjust her status after you get a marriage license so you can not use the one in India has to be one form here.( judge or religious)
      i hope this helps.
