  • I-140 approved, I-485 pending, use AC 21, H1-B will expire on 12/2012 Please help!

    Hi,

    How are you, all,
Please help me with my case below.

I got I-140 approved on APR/2012, and I filed I-485 on APR/2012. We have EAD CARD till May/2013.
Had an interview on Aug 27/2012, need to send current job offering letter and some other docs to USCIS by Oct 31st 2012.
I am in 30 weeks pregnancy and I am not working now. I stopped working with I-140's company two years ago.
Some how, the company change the management team, the new manager won't provide the job offering letter to me.
Therefore, I found an new job after I-485 is pending 180 days on Oct 19th/2012 and I am sending the "NEW job offer letter" to USCIS. Using AC 21. I plan to go back to work one or two month after I give birth on Jan/2013.
My H4 and my husband's H1b is going to expire on Dec 13th/2012

My question is, Is it risk to use AC 21 on my case? (but I don't have choice to provide the "New job offer letter")
should my husband apply H1B and H4 for me to keep the status if we got denied?
If we apply H1B H4, is it going effect I-485?

Thank you very much for your time and help

    Momo,
