  • Interview Done, No work Permit or Letter

    Hello guys,

I have a few questions and would be really grateful if anyone could asnwer them for me.

My wife and i applied through marriage. We filled for work permit and adjustment of status. I got my letter for bio-metrics and got my finger prints done. Then within a month i got a letter for my first interview. I wasn't expecting it so early but i guess thats a good thing right?

We went to the interview in Hartford CT, and the interview was very easy and quick. We think we did very well as they asked us not many questions just basic simple questions. I was very surprised my work permit hasn't arrived though. I asked the officer why i didn't have it yet, she said she wasn't sure but it could be because everyone is applying for the dream act. I asked The immigration officer about the resident card and she said it can take up to 4 weeks to 6 weeks for me to get my resident card and as soon as i get it i wont need the work permit because i can just get a social security number with it. It has been 5 weeks now after the interview and i haven't even received a letter or anything. Should i have gotten a letter after the interview? Is something wrong with my case?

I went to the uscis.gov site and looked up my case and it still says Initial Interview for work permit and for the adjustment of status it still says Testing / Interview

let me know what you guys think as we are worried.

edit: if something was wrong it they would send me a letter right?

Date of first interview: Nov 6, 2012

Did the officer approve your application at the interview? Sometimes they can’t make a decision right away due to missing paperwork etc. The application for a work permit usually takes about three months to process.

they officer did not specifically say it was approved she said everything looked good and in order. she was just going to double check everything after we left. When i asked her about the work permit she said i could come back in a week and get something stamped and im guessing this is for the a temp work permit. She said "If i were you i would just wait for the resident card because when that comes in you wont need the EAD, but if your in need of the EAD we can stamp it. so im guessing it all went through?

It sounds like there shouldn’t be any issues. If it was less than three months ago you submitted everything it’s normal that you don’t have your EAD yet. I don’t know the reason why they didn’t approve your application on the spot, but sometimes they need to verify documents or wait for the documents you submitted upon your arrival at the airport (sometimes they get stuck there for various reasons). If I was in your situation, I would give it another three or four weeks before calling the USCIS. Waiting for approval is not very amusing, but in your case it seems like it’s going much faster than normal, so that’s good at least.

Congratulations on your successful interview experience. Remember what the officer told you during/after the interview, "(When i asked her about the work permit she said i could come back in a week and get something stamped and im guessing this is for the a temp work permit)?"

That stamp she (the officer) was referring to was not a temp EAD-there's actually nothing like that, but a temporary GC (usually valid for 1 year) in the form of a stamp that's affixed in your national passport.

If it's been more than a week after the interview like she suggested, I would advise you to make an INFOPASS appointment at your local USCIS office to have your passport stamped with the temp GC stamp which you can use to do anything else (get a job, open a bank account, travel overseas, etc,), just like having the actual GC in your hand, while you wait for the arrival of the actual GC.
And the temp GC stamp is FREE of charge. It's up to you to act on that or not. All the best.

Hi , Just curious, is anyone who has concurrently filed & is in the process of awaiting EAD eligible for this stamp ? & If it is stamped, does that omit the use of the EAD when it finally arrives ?

For you to be eligible for the FREE temp GC stamp, your GC case must have been approved either during or after the interview for such an card. Some offices are able to affix the said stamp in the prospective GC holder's passport.

Applying, awaiting or having just your EAD approved while your AOS is pending does NOT make you eligible for the stamp.

And yes, the temp GC stamp supersedes the EAD, since the GC stamp allows you to travel anywhere outside the US & return whereas the EAD does not, unless it's an EAD/AP combo card.

Am sorry I meant to have concluded the sentence that some local offices are able to affix the temp GC stamp in the prospective GC holder's passport the same day as the interview if said office is able to approve it on the day of the interview.
