Hello All, i need some advice for my I 485 application. OK let me give you some info. Presently me and my wife are both in H1B visa. We got married before i started our GC process. Yes, that was even before the labor certification. My wife is applying with me as my dependent.
Everything was fine up to my I-140 approval. My PD date is current and so we were about to apply for I485, then came the bad news my wife is diagnosed with non infectious TB. Hence, she could not get the TB clearance, she is currently taking TB medication which is for 9 months. I am in a sticky situation now and don't really know what to do. Asked my lawyer about it but was not much of a help. Here are my options,
1) wait for my wife to get a TB clearance which could take at least another 9 months ( my PD date could be gone by then)
2) apply for my GC now and apply for follow-to-join for my wife ( my wife is already in the US on her H1B visa), i am confused about this as follow-to-join is usually done when the spouse is abroad but in my case she is here in the US.
Can anyone please help me with this.
