    Hi guys!
    We just completed my I 485 on Dec 29, 2012. I got here with a K-1 visa. We got married in April 2012. We werent able to file immediately because of financial reasons. Is this still okay? And also what am i supposed to wait for now? Am i going to receive some sort of notification from USCIS telling me that they have received it? I tracked the package, it got to the Chicago office on Jan. 3, 2013. So far, i havent heard from anyone yet... And then how long does it usually take to physically have a temporaru green card?

    Thank you guys for you help!

    It should be fine even though it's been a while since you entered the country. Even if it's not ok you can't do anything until you hear from the USCIS. Quite soon you will receive an I-797 confirming your application. After that it should take one to three months before they arrange an appointment for the biometrics. The entire process normally takes around three to six months.

      As long as u married your K1-Fiancé within 90 days of their arrival in the US (before the expiration of their authorized stay), u should be good to go. You can even file for the AOS after the expiration of their authorized stay and it shouldn't hurt or affect anything.

      It may be likely you would be receiving both form I-797C, Notice of Action (receipt of payment(s) & fingerprint biometric appointment notices) at the same time. You can expect to receive both notices in the mail within 30 days of the official receipt & acceptance of your completed application. Sometimes they may show up in the mail at the same time. If you applied for an EAD concurrently with your form I -485, u can expect to receive that document within 3 months after its receipt, but only after going in for your fingerprint biometric notice appointment. The adjustment of status from K1-Fiancé to that of a Permanent Resident status can take up to 9 months or in rare cases, a little longer, but it could also be as soon as 3 months. Each case is unique. It's also worthwhile to note that, the interview in this type of case could be waived by the adjudication officer.

        Deathrow2020 and wavedom: Thank you guys for replying! Yeah, We got married within 90days of my entry here, We made sure we do that. We also called their hotline to ask if theres a deadline for applying for an I485, the operator said theres none. But I wanted to make sure so I asked here again. i didnt apply for an EAD. But I understand once your I485 is approved, you do not need to apply for an EAD? Am I right? And speaking of EAD, i guess without it even if u have an SSN, you cant apply for a job yet huh? and also, once you have your temporary green card, can you leave the country? I miss my family back home and I wanted to see them so bad already!

          You can start applying for jobs, but the employer needs either an EAD or a green card when it’s time to sign employment papers. Once you have your green card, you don't need the EAD anymore. You can leave the country using the conditional green card.
