  • I-94 card expiring and I-485 pending

    Hi,
Our I-485 is pending and we are holding valid EAD/AP status. EAD/AP is expiring on April 9, 2013 and we have already applied for renewal of EAD/AP card.

Currently, my wife is working on L1B visa which is expiring on March 3, 2013 and her I-94 card end date is same as the visa expiry date. Since she will be still staying in USA post March 3, 2013 maintaining her legal status on EAD, do we need to apply for her I-94 card renewal through USCIS or is there any other way do it (for example at the airport).

Anyhelp in this regards will be very helpful.

    Thank you,

    Bhaskar

Yes, her employer can file for the L1 extension, if she did not max-out on L1 (5 years).

      Hi binoca82,
She is not going to renew her L1 visa. She will move onto EAD status.

In one of the forum i read that once we are on EAD/AP status, it is not necessary to renew or maintain I 94 card. I don't know if it is true. Can you please advise. Thanks.

Well, that's true, it's not necessary to extend the I94. But, it will become useful if I485 is getting rejected.
