  • RFE, NOA1 not received, G-1145 not used or was ignored

I-130, which had been filed in October 2011 was finally approved December 2012 so we were not worried about the I-485 that we filed in March 2012. However, after we moved into the new year, we decided to just call and check, and after a week of getting no information from anyone, we finally were put in touch with a tier 2 officer who told us that an RFE had been sent out in March 2012!!! WHAT??? We never received it (have been at the same address for 5+ years) and we are really worried.

    So my questions are:

    i) The RFE was 10 months old by the time we found out about it (and we responded immediately) so what will happen now?
ii) Why would we not receive a text or email when we had filled out the G-1145 form?
iii) Since we never got any information from USCIS and we thought they were still working on the I-485 (remember it took 12+ months to get any info at all on the I-130) will they reject the response we sent them?

RFE, NOA1 not received, G-1145 not used or was ignored - UPDATE

I-130 was finally approved in Dec 2012.

We had to refile I-485 in Feb 2013 as it is obvious the previous one got mislaid somewhere. USCIS says they sent it back with the checks due to incomplete information, but we never received it (again, we haven't moved in years). We are now getting updates on the refile.

koolkid, I think you should pose this question on the main forum. However, I think you can keep your priority date. I just googled about children aging out and it seems they keep their original date but I'm not sure. Please post to main page.
