I got married in December 2007 in India and my marriage certificate has my dad's first name as my middle name. I was ok with this at the time because I didnt think It would be any problem. Now 5+ years later, we are ready to file 485 and my attorney says this is going to be a problem since all my other documents (birth certificate, driver's license, passport, H1B etc) have just my first name and last name with no middle name.
We visited the Indian Embassy and even tried to contact authorities in India but they all say that they dont know how to fix this since I can't prove on any other document that I am the same person. I do have tax returns in which I filed jointly but all these also have just my first name and last name. My wife's H4 applications have all been approved in the past as well but i believe USCIS scrutinizes the Identification process much more at the 485 level.
At this point it seems my only option is to draft an affidavit explaining the problem. Does an affidavit carry a lot of weight in this case?
