  • My case: I-130, I-485, I-765

    I'm trying to get my green card through a marriage to a US citizen.
    We met online 6 months ago and at first she wanted to come to me, but she couldn't and then we decided that I come to US to see her. We hit it off immediately (as we did online) and we are getting married on April 8th.
    After we get married I'm going to send all the papers for the green card.

    I have couple of questions.

    1. It says you can send I-765 at the same time as I-130 and I-485. There is a fee on USCIS site but I've read somewhere, if this is my first time filling the I-765, there is no fee to pay. Is this true?
    2 Will they complicate because we got married so fast?

    Actually that is all for now. I think I will have a couple more questions in the future.

    I think we have pretty clear case accept for the affidavit of support. She didn't make much money last year, so this is still a problem.

    Can anyone help with the first question?

      Applicants filing for this benefit at the same time or while an Adjustment of Status (I-485) application is pending are not required to pay any fee as it was included in the "total cost" of the I-485.

      For your second question, you must prove it's a bonafide marriage.
      - If she don't have enough to sponsor you, then you people needs an affidavit of support.
      - You can send all 4 forms (I-485, I-765, I-130, I-131(Travel Doc) together but each form requires its own set of supporting documents.
