  • entering Us on B1 / B2

Hi I have been married to a US citizen for 2 years we have been living in Mexico but we wish to move to the United States.

I havwe donde research and know it takes 7- 12 months applying in the consulate in Mexico.

would it be legal for me to enter the us with a b1/b2 and apply for my greencard while I am there?

    thanks

I would strongly recommend not to do that, at least not quickly after your arrival.

The USCIS utilizes a rule known as the 30-60 day rule.

In short: if you apply for AOS within 60 days, you are assumed to have misrepresented your intentions when you applied for admission at the port of entry based on your B1/B2.
