I need advice if someone had similar situation/foreigner marrying LPR
Hi,
I would like to know if someone had similar process and if not, if someone can help me with this.
Long story short, I'm a LPR, just ended divorce with my ex wife through I gained my LPR. I had LPR status for 2 years so far and I'm still far away for applying for Citizenship.
I am in a relationship with foreigner, who legally entered US on her B1/B2 last year and overstayed her 6 months period. I know it doesn't make difference but she has a valid 10 year tourist visa and stamped I94.
If our relationship works out and we get married, my questions are:
1. I know we can legally apply for I130 and wait a long time until I gain my Citizenship in aprox 3 years.
2. Is applying for I485 defiantly a NO?
3. The main question: Anyway she can apply for EAD/AP after the marriage? Anyone had experience with and how long did you wait?
I understand that you will suggest that's not smart to get married or that she needs to go back, but, please, there has to be someone with similar experience?
