  • I-485 help PLEASE!

    Hello!

My dad came to the USA as a refugee in the 70s. We have his I-94 and are trying to get him permanent status.

    1. There is no way to track down his birth certificate since he was born in Vietnam. I've called everyone including the Vietnam Embassy. What is the alternative? And how would I go about getting it?
    2. Will they need a marriage certificate?
    3. He owns his own body shop, so he is self employed. Would they need to see any other documentation for that besides his tax reports?
    4. The form I-693 vaccination form they are having him include with the application says it needs to be filled out by a civil surgeon... what is that? Can the doctor he usually goes to not fill it out?
    5. Does he have to pay any kind of fee since he is a refugee?

I am trying to help him do this without having to hire an immigration lawyer, so any info would greatly be appreciated.
    Thank you in advance!

1: There are a few alternatives available, but this is something you can best discuss with an immigration attorney...

2: Yes, if his wife wants to adjust as well. Otherwise, no.

3: No, that is not required

4: No, a civil surgeon is has a special license. The procedure is very simple tho.

5: As a refugee, just the biometrics fee of $85 should be sufficient.

Despite the cost, I would strongly recommend to consult an immigration attorney to ensure his application will be successful. Worst case scenario, he could be deported.

I know a very good immigration lawyer. I recently hired her for my case. I'll be happy to give you her contact details.
