My wife applied for her Green Card (with me as dependent) thru her employer for whom she continues to work since 2001. Her I-485 got approved on August 16, 2004 and she got I-551 stamped in her passport on Nov 24, 2004 valid for a year. She has not received her ‘actual’ green card yet.
I received a RFE on my I-485 application (proof of age and parentage) to which our lawyer responded on September 16, 2004. I have not heard back on my I-485 application since then. I am currently on my third EAD.
We are all set to move to a far away state where I have accepted a new position to begin Sept 1st. Our plan is that she would file her resignation from her position on Monday, August 29 and join me in 2 weeks. She would take @ 5-6 months break from work and then look for a position in the new state. Our question is- is there a problem here. Specifically,
a) does she have to continue to work for her Green Card Sponsoring employer till
(i) she gets the green card in hand? and/or (ii) till I get my I-485 approved?
b) can she take a break from work for 5-6 months and search for a job in the new state?
c) Is there any problem in renewing my EAD (if necessary) if she were to resign from her Green Card Sponsoring employer?
