Green card interview went well, but no decision - file being held for review

    Sorry to hear that striker but be patient and dont force them too much just pray to God and hopefully in upcoming 30 da6s you will hear something good I researched alot normally people on the waiting get their greencard after 90 to 120 days after the interview mine so far is 60 days hopefully will get it soon be positive

      Yeah I normally would not be too upset but we made travel plans for a delayed honeymoon based on their word that we are good to go. That's whats aggravating me more so than anything.

        So my wife did a "walk-in" appointment as she was getting extremely antsy about the situation. The officer on duty berated her for not having an InfoPass appointment but ended up helping her anyway. The officer confirmed that our original officer has not done anything since we went in two weeks ago and now that she will re-assign our case to someone else to look at. She also said that next Monday (actual date of our appointment) we should come with a plane ticket for a few days after that to force their hand and approve us there and then. Such an odd recommendation

          I went to my infopass yesterday and the guy said that it is still in review and I will be hearing from them soob .bs. but any way m calm for it for now hoe they do sonething quick

            So some good news to share. Got the Card Production email last Friday and got our passport stamped yesterday. So relieved this process has come to a close. Good luck to all those who are still waiting and best wishes for a speedy approval!

                Had My Interview Yesterday...

                Hey Folks, My wife and I appeared at the LIC facility in queens yesterday at 9 am for an I-485 interview. Although, we had to wait for a couple of hours until our attorney went to the help desk in order to seek why is it taking so long for us to be called in. While, she was there, the IO called my name and we went in. The IO was a short redhaired old lady who directed us to the room where she was going to conduct the interview. We entered thru Room A. We were sworn in and seated. Then before she asked me anything she began looking at the our file. Then she started with me asking 'how did we meet'? and then half of story came from and the rest came from my wife. The officer looked satisfied with it and then she asked me whether I dated any American woman before her, I told her no I didn't physically date anyone, they were all limited to telephonic conversations. Then she asked me why didn't I go back to my country i.e Pakistan if I didn't graduate from my school, and I gave her pretty valid reasons for that. So that also went well, she asked my wife about my family and how many siblings I have and what are their names? my wife was able to answer the questions correctly.
                And then she asked me what I was doing at present. I said I am awaiting my tlc license at present so that I can save up as much money to go back to school and finish my education. The officer like my reply, although she had a pretty serious face but joked around with us as the interview progressed, she asked me most of the questions regarding how long did we date for...when did we move in together...what future goals and aspirations do we have and do we plan on having children in future etc. My wife is a hispanic american.
                My wife had been arrested for assaulting another person years ago but the case was expunged, and the officer didn't notice the name on the disposition and thought that it was my arrest disposition, but later on when she found it that I was never arrested when I told her that I have never been in trouble with the law, so she was rest assured. The we asked for our joint documents. We presented her with our residential leases bearing our names, letter from the bank stating we have a joint account there, utility and internet/cable bill having her name my name respectively. Then she looked at our photo album and asked me about a photo we had with my wife's school friend at her house. She pulled out 4 four photos from different occasions and asked me about them and wrote something on their back and asked me if she could keep them, I replied affirmatively. she she asked for my passport and pulled out the I-94 from there and attached to her file. In the meantime, while pointing out at my birthdate she talked about how a lot of people are born in September and went on talking about her family and stuff and Halloween that's almost here.
                After collecting all the documents like letters of affidavit from us, copy of our bank letter, copy of my EAD, copy of our state issued Id's, our leases and proof further proof of same address, she said that she doesn't seem that there's a problem with anything and then she said she will escort us out while shaking hands with me and my wife and wishing me best of luck with my future. She handed me a piece of paper stating that "my case is being held for file review in order to prepare a decision."
                When we came out from there the attorney told us that it went well and there is nothing to worry about, you will get your approval by Monday since the interview was on Friday. So I was happy that it wetn well and even told all my family that all is well. So folks who have been through a similar situation and have received their green card now, please advise me how to react to this...and who are still to appear for the interview its a latest heads up for you folks.

                  Exact same thing happened with us last Friday...

                  This is what exactly happened with my wife and I last Friday when we went to our interview at LIC facility. The interview went well, the officer said, she doesn't see any problems with our case, took my I-94 that was stapled to my passport along with the rest of the documents(i.e lease, bank statement, bills, proof of same address, copies of our NYS ids and life insurance paper)and put them in her file. Escorted us out and wished us all the best for our future. But this left me in the grey as I was also expecting either a stamp on my passport or a paper saying that we are approved, but the paper she gave me stated that 'your file is being held for review before a decision can be made on our case'.
                  Our attorney told me not to worry as everything well went. She told me I can check my updated status on uscis website stating that I am approved any day next week. My attorney said that this procedure is common now a days since the officer doesn't tell you that you are approved on the spot, that obviously leaves me baffled. But she also said that I can receive my green card in two weeks time. Can you tell me how long after the interview did you receive an online approval and then your green card? Thanks

                    No Descision

                    Hi All,
                    I am a GC holder wife sponsoring my husband. My husband and I had an interview on last Tuesday. USCIS office was nice, interview was very short, he asked a few basic questions and took no proof except of two wedding reception photos and told us to wait for the decision in mail. My husband is on H1 visa through his employer and he's currently out of status because his H1 visa renewel is in process. Any thoughts would be appreciated!

                      By law, when someone is married to a Legal Resident or Citizen, it erases the out of status issue. And is eligible for adjustment of status. A lawyer showed me the book on this one.

                      In terms of job, only if he works for the government, then there is an status issue, otherwise, if it is for a private company then, USCIS does not care.

                      Your spouse should be receiving the approval letter within 3-4 weeks then green card a week after.

                        I'm sorry, but you may have misunderstood how the regulation is applied. Marriage to a Green Card holder does not automatically provide eligibility to apply for Adjustment of Status. "Immediate Priority" status only results from marriage to a U.S. citizen. If one submits the Adjustment paperwork after marriage to a Green Card holder, without waiting for an I-130 Priority Date to be current, the I-485 package will be rejected and returned to you. After marriage to a Green Card holder, one can submit the I-130 to obtain a Priority Date, about 18 months or more later, after which you can submit the I-485 paperwork.

                          Filed and Got GC within 3 months With These Steps

                          I came in with a F1 visa. Went to school for two semesters and ran out of money because I couldn't get a job to pay for other semesters. Eventually, I stopped going to school. Got married to a U.S citizen in January 2015 and filed in March 2015. My application was received and I received notice of receipt a week after. April 16 I went for biometrics. April 23rd I got notice for interview scheduled for May 28th. I went in for interview, it lasted 10 minutes. I was asked 3 questions: 1. My in-laws name, 2. How I met my wife and 3. If i have ever worked before. The interviewer asked if I have any questions. I told her I never received any Employment Authorization card after biometrics. The interviewer said I shouldn't worry about that since my GC will supersede EAD card because she already approves me for permanent residency. I thanked her and we left. 1 hour later I got an email that my card was being ordered and hours after I got another text that my GC is being processed and will be sent to me. Got approval notice on June 2nd and card mailed June 3rd. I received the actual card June 5th.

                          Below are the documents i enclosed in the envelope while filling

                          1. Form I-864
                          2. Form I-765
                          3. Form I-485
                          4. Form I-130
                          5. Form G-325a filled by me
                          6. Form G-325a filled by my wife
                          7. Form I-94

                          PS: if your sponsor is a citizen by naturalization, he/she must attach her naturalization number n documents so that it won't delay your card even if approved.

                              This is not quite correct. Visa overstay and unauthorized employment is only forgiven in adjustment of status applications based on Immediate Relative petitions. Someone whose visa is out of status is not eligible for adjustment of status based on marriage to a Lawful Permanent Resident. The adjustment statute is section 245 of the Immigration and Nationality Act, 8USC1255.

                              INA245(a) describes in general terms the concept of adjustment as a form of discretionary relief. INA245(c) goes on to limit those eligible for adjustment of status. It reads in pertinent part:

                              subsection (a) of this section shall not be applicable... to an alien (other than an immediate relative) who hereafter continues in or accepts unauthorized employment prior to filing an application for adjustment of status or who is in unlawful immigration status on the date of filing the application for adjustment of status or who has failed (other than through no fault of his own or for technical reasons) to maintain continuously a lawful status since entry into the United States

                                FBAS Greencard. I received my AP document so quick but what happen to my EAD?

                                It is your permanent resident it's conditional 2yrs.? Or permanent resident for 10yrs.?
                                Im happy for you because the processing of your GC is very fast.

                                Me, I need to wait my EAD and I wonder why after my biometrics I dont receive an approval notice from their online.
                                It two weeks i have not yet reveive my EAD that I need to work for my family. We're married for 17yrs to my USC husband and now we are financially need of income to support esp. My husband have cancer.

                                My husband filed my concurrently I-130, I-485, I-764, I-131. We submitted April 28, 2015 to USCIS.

                                I come here legally with B2 VISa because my husband works outside in the US for 30 yrs. He will come here to vote and some urgent or family emergency. Now, he returned to US because of his Cancer treatment because he had an insurance here in the US for his health issues. That's why I'm here to take good care of him and I'm qualified nurse and we filed my application for AOS so that I can work here for marriage based family Greencard.

                                Now, my problem why until now (2 weeks after biometrics) that i didn't receive any mail or text msgs about my EAD. I need to work immediately because we need to survive esp. We have a child.

                                I dont know if our application I-130, I-485, and I-765 are approve. I only receive now my Advance parole document, I was thought it will combine or together with your EAD ATM card.

                                All our application we complete with supporting documents like sealed medical and so on.

                                I dont even get my mail for the Interview appointment. I need my EAD card so that I will start searching or hunting a job. I only received my AP today but my EAD have not yet receive.
