I am in preparations to file I-130/I-485 (spouse-sponsored). I have a stamped I-94 but after the date of the I-94 I went on a short trip to Canada. My passport was stamped on the Canadian side. However, as usual for short trips to Canada, I-94 was not collected and CBP didn't stamp the passport on the way back in. Since this time, my visa has expired (H1B was renewed, just haven't got the stamp yet). Has anyone had any experience with this? I'd rather not have to wait a month and go through the expense to leave the country for a week to get a new visa stamp and come back in before filing just to prove lawful entry but this seems like it might just be the cleanest way.
