I am in an Asylum Case. The case has been pending since April 2010, and has constantly been put off so still to date there is no master hearing that has been heard. My wife (US Natural Citizen) & I were married in June after being together some years.
We are about to file the I-130 but I am a little confused...I understand that as I still have not been discharged form the courts, that one may not file an I-485 with their I-130.
I want to make sure I understand this correctly. Assuming the I-130 is approved, so I then take the receipt and (hopefully) the approval to the Court and have the Judge approve the I-485? If so, do I present a check there and then for the I-485 also?
I wouldn't mind a little private advice on this from someone with experience.
