485 application for spouse if priority date is not current

Hi,

My husband had applied for his 485 before our marriage when the priority dates had moved ahead and it was current. He is currently working in US on EAD.

After marriage, I came to the US and am working on H1B for 5 years now. We are both Indian nationals.

Can we apply for my 485 and get an EAD even though his priority date is not current?

Please advise.
