I am British, my wife is US citizen, married for years, both retired and recently applied for green card. I just received a request for initial evidence, suggesting we seek a co-sponsor due to inadequate income.
I made a mistake in that we did not submit a 1099 (which would have shown our SS earned Retirement Benefit - as against the tax return which showed an adjusted gross income of $0). In addition my wife now has a part time job so our situation has changed. The combined retirement benefit and salary come to over $24,000 per year, well above the guidelines.
I have SS Benefit Verification letters for each of us, plus a letter from her employer so have two questions:
1) Do I need return anything other than the three letters and a cover letter?
2) Should the covering letter come from me or my wife (the petitioning sponsor and author of the Affidavit of Support).
