    I am currently here in the US under an H1B, and just married my girlfriend of long time. I am currently preparing the I-485, however, I have been arrested earlier this year (march) with regards to a DUI. I was released without bail and immediately hired a lawyer to defend me. My DUI case is still pending and my court date is scheduled for end of January 2014. In the meantime, we are going to be filing these documents within the next two weeks.

    As such, I was wondering what documents I should provide as evidence (as per the I-485 instructions) in the packet I am sending. Any ideas?

    Furthermore, having been finger printed as part of my arrest, will I have to be re-fingerprinted as part of the I-485 application?

    Lastly, I came back from Europe (which is where I am from) this summer after visiting my family and it appears that they stopped using the I-94 as of earlier this year. As a results, what evidence should I include in the packet and what should I put in the I-130 form?

    I appreciate your help.

    You should include the adjournment letter copy where it stated the schedule date of the case plus any other evidence you have. What are the charges they have on you.

    What documents to be submit along with 485 it was mentioned. ( It may be same as I-130 docs)
    Once your application is accepted, you will get a NOA, then you will get biometric appointment to go and give your finger prints. (You no need to do any thing this time for finger prints)
    Photo copy of the stamp on your passport.

      Thank you. Well the case is still open, but they charged me for a misdemeanor due to the DUI I got arrested for. My hearing is scheduled for January 27. After doing a lot more research, do you think that the Hearing Notice documentation will suffice when filling the I-485? By the time I go for the interview, the case hearing should have passed and I should have more documentation as to the agreed arrangement I could provide the immigration officer. Thoughts?
