    I am a Cameroonian by birth and nationality.I came to USA with a B1 and B2 visa to attend a conference in Washington DC, admissible by a US Immigration Officer with proper inspection at a port of entry (Philadelphia airport).I eventually fell in love with a U.S.Citizen and we both decided to get married.It should be noted that my eventual marriage to the U.S. Citizen is a bona fide one,enter in good faith and trust with the mutual intention to live together as husband and wife (life partners) and we both live together in Huntsville - Alabama.
    My purpose of writing is to know whether is it possible for me to apply for an Adjustment of Status from within the U.S,despite the fact that I have over stayed my visa. As well as eligible for a permanent residence status (Green Card via marriage to a U.S.Citizen). Because her causin told her that since my visa has expired it's impossible for her to petition for me for a Green Card as well as an Adjustment of Status based on the fact that i'm out of status since two months ago.That the only solution is for me to return back to my country of origin and filled for me via the U.S Consulate in my country.But she is worried that at this point we she can travel to Africa.Sir, I will be very grateful and delighted if you can support me with legal assistance,advice as far far as the whole process of Adjustment of Status is concern. More over my spouse is unable to find her Consular Report of Birth Abroad of a U.S.Citizen or Certification of Birth since was born in Frankfurt Germany during that period her dad was a U.S Army and was sent to work in Germany.She neither have a U.S Passport and has never applied for one.Please keep us abreast on what to do.I will be very grateful and delighted if your can support me with legal assistance and advice as far as the whole process of Adjustment of Status is concern.

    If you leave you will never be allowed in to the US cos you over stay your visa, best is to go on with adjustment of status since your married to a US citizen the can forgive your over stay so you need to start your process as soon as possible but don't make the mistake of leaving. Goodluck.

      "ramz" is right, USCIS is willing to forgive your overstay even if your visa expired and you don't have any criminal record and your marriage is bona fide they will forgive you but DO NOT LEAVE the country or you will be bared from 3 up to 10 years, nothing to be afraid if your marriage is real, file your AOS...
