Hello All -
I would appreciate guidance on my situation:
My employer filed a PERM EB3 application for me at Location A. I was at Location A for around 4-5 years before moving to Location B (this is a different state) for the same
company. At Location B I do the same work and am at same position. When moving to Location B our company lawyer filed for an H1B amendment for new Location B.
Basically, I telecommute and it does not matter where I work from, however currently my H1B is only for Location B.
Now,
The PD is current. My lawyer states that we will have to amend my H1B to Location A before filing for AOS else they will need to file new PERM.
Is this the only option ? If yes, can I move back to Location B once the AOS is approved or by using AC21 if it takes more than 6 mos for approval.
Is this line of thought right ?
