  • adjustment of visa status

    Hello guys...

    I'm a US citizen and I recent got married. I'm filing my husband as adjustment of status and started my paper work. I got few questions;

    1) can his cousin sponsor him and fill the affidavit of support?
    2) do I submit the biometric form along with all other forms?
    3) what are the strongest evidence that I need to submit?

    Jazakallah

    1. You, as the petitioner, are the "primary" sponsor and need to provide an I-864 package. Anyone else 21 or older with U.S. citizenship or legal residency can be a co-sponsor.
    2. What do you mean by "biometric form?" You must submit G-325A forms for both of you with the I-130, and of the applicant with the I-485. A "Biometrics" appointmenet notice will later be mailed to the applicant.
    3. All required forms and supporting documents are equally "strong." What is initially looked for at USCIS "intake" are currency of forms, valid original signatures, correct fee amount on checks, and correct receiving address. Any of these can result in a package rejection and return.

Thanks for the information. I-693 for the biometrics with the $85 fee should be submitted along with the I-130, I-485,G-325A and the I-864?

The I-693 is for the immigrant medical exam (not "Biometrics").

The fees to be submited are $1,070 (I-485) and $420 (I-130). The Biometrics is included in the base fee.

Also include forms I-765 and I-131.

            Gbshah,

Since you are not a U.S. citizen, you cannot Adjust your husband's status (until notified that his Priority Date is reachable). You must first submit the I-130, with G-325A forms for each of you, and $420 fee.

You then wait to be notified that National Visa Center processing can continue.

Spouses of Green Card petitioners are reachable very fast of late, but I would still recommend that you wait for the petition approval before proceeding with the Adjustment processing (if he is in the U.S.), or with the National Visa Center processing (if he will be interviewed abroad).

If his priority date is "clear," therefore "reachable," you can start the Adjustment of Status.

You don't normally get a "reachable" letter until after the I-130 is approved.

"...an immediately available visa number, if approved..." is the test for when your Adjustment of Status can proceed.

I would wait until the you have the approval Notice for the petition before investing in the medical exam and I-485 package.
