This is regarding my employment based adjustment of status. My priority date (June 13 2008) is current for the month of November 2013 and my employer is about file for my adjustment of status. My wife is on F1 (expires in 2016) and is a dependent on my 485 application. My H1B has expired and I will need to get stamping done once in India based on an approved 797A.
We are planning to travel to India on December 1st.
Was wondering what impact does the travel plan have on the 485 filling for my wife and myself.
Can I apply for a new H1B visa while in India?
Upon exiting USA will my wife's 485 be abandoned?
If my wife's 485 will be abandoned will her F1 remain valid?
What is the recourse for my wife when she reenters the USA on 3rd of January 2014?
Will she need to file for I130 or can she be added to my 485 application with the priority of June 13th 2008 as of November 2013? OR will the priority date June 13th will be considered as of January 2014?
