F1 previously married

    Hi. I am F1 student engaged to USC. I was previously married here in US not to a USC, got divorced last February, moved to my BF in August. My question is: how long should we wait before getting marry and applying for AOS, so my ex marriage won't be a red flag! ?Or can we marry whenever we want but wait some time to apply for AOS. My F1 status isn't expired, I still go to school, had no intent to marry a USC and stay,but since I've met my fiancé everything is really good and his parents insist on us getting marry. Please give some advise Thank you

    Marry now to establish your "basis," and to make his folks happy.

    Do your I-130 and I-485 submittals when you are ready, so long as your F1 is still valid.

      Thank you. So as I understand, we can marry whenever we want just do not rush with applying for AOS,so immigration officer won't have questions ?

        Your marriage now won't be particularly detrimental to a petition and Adjustment procedure now or later.
