  • Have just mailed i-485 10 months after the i-130, what can I expect?

    Hi

After filing our 1-130 back in feb 2013 when me and my USC husband were still living in dubai we have not received anything about it since, except a transfer to nebraska almost 2 months ago. He moved back to the US in July this year thinking it would be any day now that i would get the green card. Our plan was to style back here, him get a new job get our apart, net set up etc and i would then receive my approval which didn't happen etc etc... Very Naive i know. Anyway I have been visiting him in the US in on VISa waiver as i am australian which expired on 26th november. After visiting the USCIS field office on nov 12th for an infopass apt we learned of the Adjustment of Status process and after consulting some people we filed for it finally on the 6th of dec (yes my VWP expired a week or so before that). We were told that pits better to let the visa waiver expire and file the AOS then leave the country and come back bc that would be fraud. Also it didn't matter that we filed the i-130 in feb this year as this i-485 would then make it concurrent filing. Anyway have sent the application off as i said on the 6th od dec, We have still not received any receipt notice or email notification we sent that form too. So its been like 10 days, the tracking said it was delivered to the USCIS office on friday a few days ago, not sure why it took a week but maybe its christmas mail delaying it.

Anyway a little worried as like I said have not received any receipt or email notifications. Other than that what can I actually expect from this whole process.. like a timeline about what will come next.

From what i know, there will be biometrics, i might get my employment authorisation and i will be waiting for my green card which will come eventually. From what I understand the AOS is basically a procedure in which you can apply for a work pemit while you are waiting for your green card to happen is how i understood it and thats all that matters to us. Our finances have taken a battering since he is the only one working and so i need to work soon! Can anyone share their AOS experience with me?

    Thanks in advance!~

Have just mailed i-485 10 months after the i-130, what can I expect?

Hello. I filed for my wife and son on August 29 2013. My wife is from Mexico City and my son was born there as well. September 6 th 2013 received all the texts of receipts from USCIS.

my wife did her biometrics on November 4 th 2013 in M***aukee Wi and we received her EAD along with travel parole on November 12 2013. The same with my son's travel parole.

AOS interview in M***aukee Wi USCIS on December 5 2013 for both and approval at the end of the interview.

Since my mortgage and utilities bills were already established before I got married I couldn't follow the typical submittal of documents of joint bank accounts- credit cards bills in both names or both names on leases or checking in both names or utilities or anything like that but I did send copies of all our dentist bills -- doctors bills. Medical Insurance statements. Letters from our family doctors for both of us along with my sons pedia doctor. Pictures of us since they came to the US. I even sent copies of the prescription bags that you get from walgreens because they show names dates and addresses. The more important message that I felt was important to the USCIS was showing a time line of names and dates and addresses along with the fact that I supported them 100%.

I also submitted all the tax info W-2s - payroll stubs etc etc etc.

When I sent all the forms and supporting evidence in a shoe box it weighed 3.5 lbs. I filled and filed all the paper work myself. Error free but I had gone over my finished petitions 5 times with a fine tooth comb before I sent them. No attorney or immigration business service.

Sure I can share a little. But hopefully you filled your petitions all correctly and the only reason I say that is cuz every form has it unique instructions on how to answer a question even if it doesn't apply to you. Like N/A or leave it blank stuff like that. Computer scanning does the petitions and uploads the answers but if certain areas are left out it may mark it incomplete

Am sure you will get the notice soon, some say he takes like a month before you get them so don't sorry, I filled in August and yet to be interviewed which is set on January , May August fillers have gotten their GC I was worried but letter found out that it's because my local office was backlog I only got the interview notice in dec 12 for jan , was waiting since September 11 that was the day I had my biometric done, I know it's hard to when you don't hear or get anything from them but just hang in there, am sure you hear something soon.
