need help with form I-485

  • need help with form I-485

    I sponsored my fiancé from Vietnam ( filed the form I-129F) and she was admitted to US as K-1 fiancée of US citizen ( she has been in US for 2 months ) , I and her were married already and we have marriage certificate . now my wife needs to file form I-485 to apply for Green card , so Does she need to file form I-130 ( I heard someone told me we have to file I-130 then wait for approval from USCIS then file form I-485 ) , G-325A and what documents should she includes ? and is the fee $1070.00 ( that includes biometric fees ? )

    A K1 entrant does not need an I-130 filed for her, just the I-485 package, with supporting forms I-864, I-131, I-765.
    The fee is $1,070 and she also needs an update immigrant medical exam to be submitted in a sealed envelope, from a USCIS-listed doctor.

      will all the form I-485 , I-864 , I-131 , I-765 and G-352A be put in the same envelope and send them to the USCIS address where the form I-485 will be sent to ?

          thanks so much for posting back ! more question please on form I-864 : affidavit of support

          I , the petitioner , do not have enough income to sponsor my spouse so I ask my brother to be the joint sponsor and in his income tax return for the year 2012, he filed as MFJ with his wife so :

          1.I have to file a I-864?

          2. my brother has to file a I-864 separate? his Adjusted gross income is 55,000 , exceed poverty guide line

          _part 3 .1 I am sponsoring the principal immigrant named in part 2 , should check yes ?

          _part 3 . 2 . should check yes ?

          3. my brother 's wife has to file a I-864A ?she is self-employed , her net profit is -1520 ( loss) , so does she need to file I-864A? ( the total income on line 22 of form 1040 is 53,480 ( 55,000-1520)

          Part 4 . information on the sponsor this question for my joint sponsor ): should he check 11.a or 11.b since he is US citizen through naturalization

          11.a. I am a US citizen

          11.b. I am a US national ( for joint sponsors only )

            Letony,

            I can't pull up an I-864 form right now, so I can't reference the form question numbers with my responses.

            You and your co-sponsor must each provide an I-864 package.

            Since his wife has a negative income on her tax filing, don't bother with an I-864A for her, and don't show her as a household member co-sponsor on brother's I-864.

            Your brother needs to include a copy of his Naturalization cert or U.S. passport ID page.

                Brother can check 11a (US citizen).

                There is a distinction between acquired citizenship and nationals by birth, but I don't see the signifcance of the "for joint sponsors only."

                    photo requirement

                    hi all !
                    I read instructions , USCIS requires 2 passport photos , IDs ... for each form I-485 ,I-131 , I-765 ... so when I file all forms together for Application to Adjust status in the same package , Do I have to include 2 photos for each form or just 2 photos for all forms ? thanks.

                      Dear all !
                      I have electronic I-94 form which print it from online
                      Admission (I-94) record number <- is this I-94# ?
                      Admit until date : 2014 January 14 <- is this the Expires date I have to put in Part 1 of I-485 ?

                        When I submit Adjustment packages, I use 6 passport-style photos, 2 each for I-485, I-765 and I-131. If also submitting the I-130 at the same time, I add one passport photo each (petitioner and beneficiary) and affix to the G-325A forms.

                        I use small plastic envelopes (about 3 x 4") that I get from a hobby store. I used to include petitioner and beneficiary photos in same envelope, but USCIS reviewers sometime "missed" the second person's photos and asked for more, so I always put spouse photos in individual plastic envelopes.

                          Thanks for posting back !
                          I have a question on Part 5 . Sponsor's household size , please
                          Persons you are sponsoring in this affidavit
                          a. enter the number : 1 ( I sponsored my k-1fiance but now we are married )
                          Persons NOT sponsored in the affidavit :
                          b. yourself : 1
                          c. If you are married , enter 1 for your spouse ( should I enter 1 or 0 here? I confuse because I already sponsor for my k-1 fiancée above , but now we are married ? )


                          one more question : in the I-94 form that issued to my fiancée : the last name is correct , but USCIS combined middle and first name into the first name only , look like she does not have middle name no more , Do I have to follow exactly the name on I-94 to fill out all paperwork I485 , I-765 ...
