  • Green Card/Advance Parole Questions

Hi. My fiancee is in the process of acquiring her K-1 fiancee visa. We are planning on getting our marriage certificate shortly after her arrival in the U.S. I was looking over the form for adjustment of status (I-485) and advance parole (i-131) and was wondering if the last name she fills out will be her maiden name, or her married name (since we will be getting married shortly after her arrival)?

Also, we are planning on having our big wedding in Ireland, but may not receive her green card before the date? Is advance parole a feasible option here? Has anyone utilized AP for an occasion such as a wedding? Any help with this would be greatly appreciated. Thank you.

To spare hassle and confusion in the future, your Adjustment of Status forms should all be in your wife's new married name.

After receiving the Advance Parole card, you may utilize that to return to the U.S. after going to Ireland for a marriage.

Thank you, Ray. Just to clarify, do you think leaving for a wedding would be a justifiable reason to receive advance parole? I am reading the instructions and it seems the applicant must have humanitarian or work reasons for AP. Maybe I am misinterpreting.

It's not an issue at all. There is no reason to be that specific about why the Advance Parole is needed. I usually include an attachment with the I-131 form, explaining that a trip may be needed for unfinished family business between "such and such" dates, but that any trip outside the U.S. won't be allowed to interfere with the Adjustment processing.
