    Hello, I am just about to send of my AOS package, Please see below for the contents and its order. Please let me know if I have included everything I need. I'm hoping it looks ok, please let me know if it needs some tweaking. Many thanks!

    Concurrent filling of I-130, I-485, I-765 and I-864

    To Whom It May Concern:

    Enclosed please find my:
    • Two checks for $420.00 (i-130) and $1,070.00 (i-485 + Biometrics)
    • I-130 Form - Petition for an Alien relative (Spouse),
    • I-485 Form - Adjustment of Status,
    • I-864 Form - Affidavit of Support
    • I-765 Form Application for Employment Authorization,
    • G-1145 Form for E-notification of Application/Petition Acceptance
    • And supporting documents


    Nature of the submission: I-130 Petition for an alien relative (spouse)

    - G-1145 – Form for E-notification of Application/Petition Acceptance
    - Payment in the amount of $420.00 payable to U.S. Department of Homeland Security
    - I-130 form
    - Copy of petitioners birth certificate (front and back)
    - Copy of petitioners passport (all pages)
    - Copy of intending immigrants birth certificate (front and back)
    - Copy of intending immigrants passport (all pages)
    - Copy of intending immigrants ESTA
    - Copy of Marriage certificate (front and back)
    - G-325a Biographic Information petitioner - One passport photo attached to back in plastic bag with name written on back of photo

    > Joint lease agreement
    > US airways boarding passes indicating joint travelling

    - G-1145 – Form for E-notification of Application/Petition Acceptance
    - Payment in the amount of $1,070.00 payable to U.S. Department of Homeland Security
    - I-485 form
    - Copy of intending immigrants passport (all pages and stamps)
    - Copy of intending immigrants birth certificate (front and back)
    - Copy of Marriage certificate (front and back)
    - G-325a Biographic Information intending immigrant - (Two passport photos attached to back in plastic bag, both with names on back)
    - I-693 sealed medical exam of Alien Seeking Adjustment of Status
    - I-884 Affidavit of Support - supporting documents:
    > Letter from employer confirming proof of employment and annual income
    > Copy of W2 from most recent year (2013)
    > Copy of Tax transcript from the same year (2013)

    - I-765 Application for Employment Authorization - supporting documents:
    > Copy of Passport biographical page
    > Copy of Passport entry stamps
    > Copy of birth certificate
    > Two passport photos in plastic bag with names on the back


    Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date.

    Two passport-style photos of applicant should be with the I-485, I-765 and I-131.
    One each passport-style photo should be with the I-130.

      I am not submitting an I-131.

      In my contents I have stated that there is two passport-style photos of applicant (alien) with the I-485and I-765

      and

      One each (petitioner and immigrant) passport-style photo in with the I-130.

      Perhaps you missed it?

      Is everything else ok? and correct?

          I am curious about the fee for the i765 application, it is not mentioned in the package in the thread that the person started here.
          Is one exempt when filing my other applications such as the 485 & 130?
          Also can someone be specific about the photos needed for the 485, 130, 765 & 325, how many total for each petitioner and applicant?
          Lastly if someone have information about not filling the 864 petition for support form, I have a friend who did not file it and it was not an issue.
          The reason would be the petitioners marginal ability to show financial support. Is it interpreted that the applicant can support him self when filling the temporary i765 work permit?

            Rightform,

            When submitting the $1,070 for the I-485 package, there is no separate fee for the I-765, as the I-765 processing is included in the base $1,070 fee.

            Two passport-style photos each of beneficiary should be included with the I-485, I-765 and I-131.

            One passport-style photo each of the petitioner and beneficiary should be included with the I-130.

            Everybody has a friend who claims to have done something different with success, and it's usually an "urban folk legend."

            The petitioner must include an I-864 sponsorship package with your Adjustment submittal, and or/ an I-864 package from him (if he lacks resources) and a co-sponsor's I-864 package from someone else. If you lack submitting the sponsorship package, you'll get a "Request for Evidence" from USCIS, and a subsequent denial and loss of fees if you fail to respond to that Request or Evidence.

              Thanks Ray, I am not sure if the circumstances makes a difference in this case.
              The applicant has resided in the U.S continuously since 1991 and has been out of status since 1991 as well, he is from Sweden and came on a tourist visa and over stayed.
              He is currently not working with his wife supporting the household, the situation with the friend was very similar and the definitely did Not
              file the I-864. If it is necessary then it will be filed but it seemed as though not many if any on these forums does file it.

              Thanks again for taking time answering, it is much appreciated.

                Rightform,

                An Adjustment of Status cannot be processed without a sponsorship package (I-864 and supporting documents). Anyone who is telling you otherwise is not speaking from experience.

                Even if the petitioner (U.S. citizen spouse) lacks the income to sponsor, she must still provide an I-864 as the "primary" sponsor, but a co-sponsor must be enlisted to provide an I-864 and supporting documents.

                  This is the answer from this person that I referred to in the previous posts-
                  Quote "We did not file an affidavit of support (form i-864), G had his own income, even though he didn't have a work permit before we applied." end quote.

                  So he worked without authorization and had an income, they did not file the 864 and where never asked to provide one.
                  Why this worked for them I don't know but they are not the first ones I have heard of regardless if it is advisable or not.

                    The reason I asked about the photos is because the person who stared this thread and had it "approved" mentioned that he had 2 photos with the 325, one each of the applicant and one each of the petitioner. He does not mention the photos needed for the 485, I am assuming that was missed on his part.
                    To sum it up; if someone would fill in quantities of photos needed please, thank you.

                    325 -
                    765 -
                    131 (not filling though) -

                    Petitioner-
