Name in birth certificate doesn't match with the passport.

    Hello,

    I'm from India. The name ( Name1) in the passport doesn't match with the name ( Name2) in the birth certificate. The name mentioned in the birth certificate wasn't used anytime in my life. My I-140 is approved and I'm waiting for priority date now. In LC and I-140 application the name (Name1) was provided as per passport and Name2 wasn't provided as I didn't know the fact that birth certificate has a different name altogether. I approached the city officials regarding this issue and they said that they can issue the birth certificate with the name mentioned as Name1 alias Name2 even though all my school certificates use only Name1. While filing the I-485 would this be an issue and how do I resolve this issue ?

    When applying for Adjustment using form I-485, you should include documents which authenticate any name changes from your birth name (court change, marriage, etc.). In most countries a passport would not have been issued unless the passport was applied for in birth name or legally-documented name change. In your case, however, you may wish to pursue how your passport was issued without proof of legal use of the name in your passport.

    In the Philippines, I occasionally come across instances of birth certificate names which were not used after birth, but different names (surname and/or given names) were used for relig, school and other official status. Inevitably, this causes a problem when either passport application or U.S. visa requirements come up, often requiring an official court, Local Registrar and national archive (National Statistics Office) name change.

        Exact same issue

        Hi,

        My birth certificate also lists the same. OldName Alias RealName . I have never used OldName in any document, not even kindergarden! My lawyer asked me to get an affidavit and then leave it upto uscis discretion.
        Do you have any other ideas? Are you from ahmedabad by any chance?
