  • I-485 and advice

Pleasant Good-day I have and question to ask and as far as I can see there are incredible amount of persons here who are knowledgeable and seem to have alot of experience which I must commend you all on.

I Came here on a Visitor Visa B2 on July 2012 to my wife house intending to also visit family member here before going back home to the Island. My wife and I relation picks up and we got married Approximately Nine (9) weeks later. I have been here since living with her My wife that is and here daughter and two(2) grand kids.

My wife is an USC but we are wanting to file for AOS with the concurrent filing method I got some one to be my affidavit of support because my Wife doesn't make enough and that person satisfy the 125% over the poverty line.

The things is this I was on her two (2) previous leases but now she is planning to move into an apartment and in order for me to be on that lease I would have to present an SS Number which I don't have, I can live with her but i just wont be on the least. Their is alot of thing that I can't do like Getting and bank account, Insurance and so because I don't have an SS Number.

I have like letters coming to my wife and I to the addresses, Photos including marriage photos of us also greeting/anniversary/Valentine cards that we have both gave to each other as-well as receipt of items we bought each other and friends written affidavits Notarize by Notary of our bona-fide marriage relationship and lease showing my name on it so do you think that is enough for evidence.

So interms of certain evidence I will be lacking to provide to USCIS because of this situation. My wife don't really have an Job; she is self employed so her income is not consistent. Another thing I will be married two (2) year coming September and I was wondering if I file my paper at the End of June. If everything goes through successfully will my green-card still have the condition on it I am going by the 90 day rule to the combo card package and green card if I get it maybe days, week or a month after my 2nd anniversary in September.

    Thank you.

Your eventual Green Card will "probably" be unconditional, but USCIS seems to exercise some discretionary authority over setting the two-year threshold. Your temporary combo card (EAD and AP) have nothing to do with the length of the marriage and will be invalid when you receive your Green Card.

Thanks for that thought, Can you please share some light on the fact that I don't posses an SS number and wont be able to be on My Wife new least, not being able to have an Joint account or even qualify for Insurance. Will that be something I should be worrying about because I am quiet sure they USCIS are aware that some of their criteria that they list as evidence a married couple will have to adhere to in-order to prove that their marriage is Bona-fide, they wont be able to achieve without Certain US Identification Medium.

You're over-analyzing. Significant evidence of commingling of assets and living together won't be needed until your actual Adjustment interview. You won't be able to get an SSN until you have the temporary combo card (EAD and AP).

For Adjustment purposes, your marriage certificate copy, and the I-130 page 2 location where you last spent time together, as well as a few photos together, will meet the Adjustment of Status and I-130 relationship submittal requriements.
