Boyfriend and I are planning to marry and adjust his status next year. This weekend, before we had a chance to move his documents from his old apartment to mine, his severely autistic cousin gained access to his room and tore up all passports, visa, birth certificate and most importantly i-94 card (the child likes to tear up paper and was unsupervised by his mother at the time). We recognize the severity of this even though planning to marry next year. Here is where we are now:
-could not locate even a piece of the i-94
-located and taped together last entry stamp from passport and photo ID part (some other pages missing)
-tried to file police report but NYPD would not grant as there was no "criminal mischief" to report (even though some pages of passport are missing still and can be floating around anywhere for someone else to use
-he has been in overstay since 2005
-planning trip to consulate to replace passport but we know old stamp will not be included
-he knows the date of his last entry (Jan. 2005) and port, airline carrier etc. but does not have plane ticket receipt or anything as was paid cash in home country.
-we are trying to find a good lawyer and would like to begin marriage process even sooner in light of current predicament
Can we do anything to prove entry?
If we file FOI and i-102, will they grant a replacement card given his status?
If we make it to the interview point somehow, will the old passport stamp be of any use as evidence?
