  • Adjustment Of Status Questions. At Home Or In The US?

    Now my wife and I have decided to move to the US. I am British and she has dual citizenship with the UK/US. We understand that we have to file an I-130 form, and then an I-1485 form.

    My question is this - do we have to complete the entire process in the UK? Or is it possible to file the paperwork here and complete the process in the US?

    I ask as we are looking to leave in the next 2/3 months. We have already started to fill out the papers and gather the supporting documents and should have everything submit within a week.

    if you are able to travel to the U.S. with a Visa Waiver or if you have a U.S. visitor visa, wait until you are in the U.S. to file the I-130 and I-485 concurrently.

      Hello,

      I hope you don't mind me coming in on this thread. I am in the same situation. My wife has dual Irish/Us citizenship, I am Irish. We want to move to the US as quick as possible. We have not filled the I-130 yet. We just heard to file from Ireland (to chicago) the process will take 6-8 months!

      Rayb may I ask why it is better to file from the US? I should be able to get in on a visa waver. Is it a viable option?

        You can enter the U.S. on a visa waiver or on a B2 visitior visa. On the other hand, if you want to start the immigration process while in Ireland, the processing won't be complete for about 8-10 months. If you enter the U.S. while the I-130 processing is underway, you can complete the conversion by submitting the I-485, $1,070, an immigrant medical exam, and a copy of the official Receipt Notice for the I-130.
