New Question About I-485 (Confused)
Hello,
I have a quick question: Can I file for change of status: Form I-485 (and Work Permit EAD) to extend my stay and get employed while waiting for my green card?
My details:
1. My father (U.S. Citizen sponsor) filed my petition for Permanent Resident ( unmarried; under age 21), in January 16, 2014
2. I-130 has been approved on Feb. 7, 2014
3. My father (sponsor) received the Notice of Action (I-797) after 7 days.
4. We enrolled the case to NVC and already have my Case Number available
5. NVC is asking for AOS payment and completing Form DS-261
However,
6. I entered U.S. on a visitor visa (B1/B2) for the first time on Feb. 11, 2014 and spent a month of vacation in Orlando w/ my grandparents, I'm still inside USA and I booked a flight to Chicago to meet with my father on April 2.
7. I acquired my visitor visa since 2008 and has an expiry of until 2018
8. The time given to me by the border control officer to stay under visitor visa is until Aug. 11, 2014
Once again, I want to clarify if I can just file the Adjustment of status and stay here longer, get a job and be more productive until I get my green card?
