  • Marriage based - AOS Testing & Interview

    Specifics of the case are below,

    I am on a H1B Visa (I-140 approved under EB2) married US Citizen and filed under F category , after initial RFE about Tax Return and Medical Certificate, the status updated to interview.

    We are related and it was an arranged wedding. I have joint Tax returns, Life/Health insurance etc. to prove a Bonafide marriage but we live in different states due to her education which finishes in month.

    Could the different address have been a trigger for the interview? What are my options? Please clarify.

    Probably not a trigger, but "separate state" residency will be a red flag about which the interviewer will want evidence.

    An interview is standard, but a high percentage of Adjustment applicants are not interviewed these days. On the other hand, after an interview, a second interview usually means that they will "gang up" on you to intimidate and look closer for evidence of a fraudulent relationship.

      so by "evidence", you mean, we would need to prove that we have separate addresses for a reason (which is her education)?

        Yes, evidence should be in two parts:
        1. A succinct narrative, signed and dated, explaining why you are living at different locations.
        2. Third-party evidence and receipts corroborating wife's school participation.

          Thanks a lot, Ray B!

          I should be able to compile the evidence, everything else looks on track.

          I may have more concerns as I try and gather all the documents, I'll keep the post updated.
