  • filing a I-485 for my spouse HELP PLEASE

    Got married to my wife on Nov 2010,we being together from Aug 2004. My wife entered the USA on Jan 2011 on a B-2 visa she was given 6 months to visit (July 2011). I filed I-130 as a permanent resident for my wife on Feb 2011(priority date) and got an approval notice on June 2011. I am now a US citizen and applying for adjustment of status I-485 she overstayed the time granted in 2011 she never went outside the country since her arrival in Jan 2011. Do I need a lawyer for this case or I can do it myself? What do I need to file the I-485 can someone give me a check list of what I need. Can I also submit I-131 and I-765 for her.. Please help...thankssss in advance

    You need to change the status of your petition for your wife to "U.S. citizen petitioner."

    You can then submit copy of the I-130 approval notice, copy of your Naturalization certificate, I-485, I-765, I-131, I-864, with supporting documents (passport-style photos, tax return, W2's, employment verification, wife's I-94 and B2 visa copies, etc.) with $1,070 fee.

        I got an approve I-130 from June 2011. My question is while filing the I-485 my wife wants to go back to Jamaica to visit her daughter is it wise to file I -131 for her to travel. What percentage it would be for the immigration officers turn her back when she's trying to re-enter the United States. You think she should jus wait until we complete d interview?

          Since your wife was a visa overstay, there is a risk that if she leaves and then tries to reenter the U.S., she will be subject to a reentry bar because of the visa overstay.

                  I submitted the I-765 with the I-485. My question is how soon will I get an approve I-765 and can I get a drivers license with the approve I-765?

                    You do not submit a police clearance with the I-485, Adjustment, application.

                    The Employment Authorization card, generated from the I-765, with an Adjustment package, usually shows up at about 3 months from submittal. The Authorization allows the holder to obtain an SSN, a driver's license (in most states), and to work legally.
