  • My wife's J1 visa will expire on 5/6/14, i'm so scared right now...

I can't send my I-130/I-485 packet until after her medical exam/TB test results on 4/24.. She still has a 1 month grace period after her J1 expires to stay in the USA. She doesn't have a two year restriction... I plan on sending my entire packet overnight as soon as I can... Please tell me that I should be okay.. Is there anything I can do to make this faster? I can't lose her.

Start by doing everything possible to insure your paperwork is complete. Have a second person with real experience at least review your package before submitting.

if they don't get to our paperwork before her visa expires, can they still process her while she is in her grace period? can they process her during her grace period if i submit the paperwork during her 1 month grace period?

Since you will have a completed immigrant medical exam on 424, in a sealed envelope (?), why delay submittal.
