Little help with the i864....

  • Little help with the i864....

    Bonjour !

    I am filling all the paperwork to pass from a J1 Visa to a Green Card, and I have 2 concerns about the i864 form (Affidavit of support):
    - 1 : My wife is a nanny. For 2012 and 2013, she regularly worked with the same family, so she has tax returns. But in 2011, she worked a bit here and a bit there and didn't fill taxes... Is a statement explaining the situation is enough? Or are the tax returns of the past 3 years a must-have?
    - 2 : While my J1 Visa expires April 30th, I quit my job last month. So, even if since then I've been working as a barista for cash, I am officially unemployed. Same with my wife, who's hasn't found any regular family yet... Our annual incomes of the past 2 years are way over the Poverty Guideline (about 55K for each year), and I am sure that I'll find a well-paid job as soon as I receive the authorization, but isn't that risky to write "unemployed" for both of us? What about "Self-employed"? Should we need a joint sponsor?

    You only need to submit a copy of the 2013 Federal tax return and W2/1099-MISC forms.

    IF you cannot probive proof of current employment, you should attempt to get a co-sponsor. Proof of sustained current income is a must.

      The problem is :
      1-she gets paid cash;
      2- so do I, since I can't apply anywhere before getting my work authorisation... actually, 2 employers are ready to hire me as soon as I can legally work.

      As we have enough savings to live till then, may a letter from one of them be enough?
      Or is finding a jointsponsor the only way?

        Seb,

        I assumed that your J1 status had you working legally, but guess not.

        If your wife can get a credible employment verification letter reporting at least $12 per hour, full time, and a decent 2013 Federal tax return, she can sponsor you.

        If not, or if too marginal, you should probably look for a co-sponsor.
