  • I-485 denied due to travel without advance parole

Hello - I am a U.S citizen and applied for my wife's (Canadian citizen) green card. She is on F-1 status in the U.S. We did concurrently filing of I-130 and I-485 on 10/25/2013. My wife traveled to Canada and Mexico for a few days in December 2013. We both appeared for an interview 3/17/2014 on which the officer notified us that the I-485 application would be denied due to her travel without first seeking an advance parole. On 3/22/2014 we received a letter stating the denial due to the travel without advance parole. I-130 was approved and received notification.

    Question:
    1. What is the procedure for re-apply?
    2. When she reapplies for I-485 does she have to undergo the medical and biometrics again, considering she did all that in October 2013 (Medical) and November 2013 (biometrics)?
    3. If she has to do medical again, can she use the same Form I-693 from the doctor that she obtain before?
    4. Does she have to pay for biometrics $85 fees again?

    I-693

Form I-693 from the doctor is valid for one year from the sign date

You have to submit a new I-485 packet with $1,070 submittal fee, and include I-765 and I-131 (for Advance Parole). The I-693 is good for a year, but you'll probably need the doctor to give you another copy in a sealed envelope.

The new Biometrics appointments are paid for with the $1,070 fee.

Try to keep your wife in the U.S. during processing, at least until she has the Advance Parole.

        Thank you rayb. Very helpful.

My wife is within the U.S. When she submits her I-485 packet, with $1,070 fees, and includes I-765 (EAD) and I-131 (Advance Parole).

        1. Does she have to include the fees for I-765 ($380). I cannot see in the instructions, no fee exceptions required for category "Adjustment Applicant -(c)(9)"
        2. Does she have to include the fees for I-131 ($360).

        Thank you very much

          Tahir,

When submitting an I-485 package with the $1,070 fee, no additional fees are required for the included I-765 and I-131.
