    Hi, please help if you can.
    A Husband becomes a U.S. Citizen days after his wife's I-94 expires on a B-2 visa. They want to file concurrently (I-130 and I-485) days before the I-94 expires so technically he'd still be a permanent resident at the time and would fill all documents as such. They want to avoid her going out of status. Can it be done successfully? What is the possible outcome?

    I think it is dependent on when uscis receives it. As opposed to the day u actually send it off. I could be wrong though

      Hopefully USCIS would receive their documents on time before the I-94 expiration date. The spouse would still be a permanent resident at the time though. Would they process the AOS all the same?

        Update

        The plan did work out, and all documents were received and the priority date was before her I-94 expired. Once the husband became a citizen, he wrote a letter informing USCIS of his change in status. The AOS is still pending but so far so good. Thanks for the help.
