  • I-824 after I-130 Approval - Please help.

    Hello All,

I applied for my mother's immigration through I-130 where I indicated that we will do Adjustment of Visa since she was living here in the U.S at that time (had multiple visit visa). I used U.S. address on the first page of I-130 form. I just got approval from the USCIS and received the form I-797 (Notice of Action) to apply for adjustment of status. Due to some situation, my mother (beneficiary) left U.S. to Germany and she won't be back for at least 2 years. In I-797 form, it says if I change my mind, I can fill out I-824 form to send the approval notice to NVC so that she can apply for visa outside of U.S. (in Germany) instead of Adjustment of Status which I originally requested to USCIS and approved for.

As I was filling out the I-797 form, on Part 2, I chose 2(D) - USCIS to send the visa petition to NVC. But, on the Part 3 on the application is asking for Beneficiary's Physical and Mailing address of the previous application or petition. My question is, what address do I put in there? Do I use the physical and mailing address of the country Germany or use the same U.S. physical address that I used on form I-130 since it's saying to provide beneficiary's information from the previous application? Please note that I-130 form has U.S. address on page 1 and foreign address on question 19 (relatives address abroad).

(I read some folks whose I-797 request got denied due to not providing correct address, hence my reason for asking).

    Thank you for your assistance.

    Erica
