  • Marriage while green card pending vs. approved??

    Hi guys,

I'm facing the biggest conundrum of my life. I would really appreciate your honest, sincere advice.

    Current Status:
    - Adjustment-of-Status filed in Dec-2013 (priority date became current after waiting 4 years)
    - Received Travel/EAD combo card
    - I-485 pending (per lawyer, should expect Green card approval around May)
    - H1B approved till Sep-2015
    - Traveled and re-entered on AP card. So current status is AP, till Feb-2015

    Situation:
I want to travel back home and get married. The girl can't come back with me right away (so not considering H4 option). I believe the best thing to do is:
Travel back ASAP (before I-485 is adjudicated), have a wedding ceremony and obtain a marriage certificate, and apply for Follow-to-join for the girl.

    Complication:
The girl's parents INSIST that the marriage should only take place in December. Not even willing to a ceremony for an official marriage certificate.
My fear is that by that time my I-485 would be approved, and we would have to use the I-130 route for the girl. BUT she will get stuck in the F2A backlog. The F2A has had 0 day movement since last 7 months, and the previous backlogs have been 3-5 years long.
I feel using Follow-to-join option now, and avoiding the F2A backlog and uncertainty, would be the right and prudent thing to do. But despite my explanation, the parents are adamant on a December wedding.

    Question:
What should I do? (Or what "can" I do)
Do I have any other options?

I'd really appreciate your advice, suggestions and feedback. Thanks guys!!

    P.S.
After waiting 4 years, when my green card application was filed, I was delighted. And now the same thing has become a source of such mental anguish, anxiety and sleepless nights

Without a marriage certificate, not sure if there are any options. You might want to see if you and your fiance could apply for the marriage license before having the actual big wedding.

    Cheers,
    Jackie
