Adjustment of status
Here's my situation:
I am an Indian on H1B, planning to apply for EB2-NIW in the next few months.
My Husband was born outside of India. He is on J1 visa and will be beginning J1 waiver in 3 years.
I am told that we will be eligible for cross chargeability.
Is it necessary that my husband and I be doing the application at the same time?
If so, is there an option for me to wait once I have my EAD, for my husband to catch up and then apply for I-485?
