  • Need help about the tax information!!

    Hey guys:

    My father in law is getting the I-864 ready for me and he Is the joint sponsor. He owns a restaurant and my question is that if he needs the w2 and the form 1099 with the I-864. Thanks for answering.

    If self-employed, your father-in-law must provide proof of a viable business entity (license, permit copies), and source income documents from his business tax return ( which could be W2, 1099-MISC or K1, depending on how his personal income is disbursed from the business).

    If his total income shown on page 1 of the Form 1040 exceeds the requirement for number of people in his household, plus you, he is okay.

      Thanks again Ray!

      What he has is the Form 1040 with schedule A, C, E, SE and Form 6251, 4562, 8960, 8582, 8867. Also the income on the first page does exceed 125% of the national poverty line of his household size plus me. Is that all he should submit with the Affidavit of Support?

        If it is an unincorporated business, and the Schedule C shows a net amount exceeding the sponsorship income requirements, and carries over to Form 1040, the income is okay.

        But he also needs to provide evidence of a viable business entity so that his claim of self-employment is credible. About 3 months of recent business bank statements would be appropriate.

        When it comes to self-employment income, every USCIS reviewer seems to look at the documentation differently.

          Appreciate the help Ray!!

          So the document I have now are:

          1. The self-employed joint sponsor's I-864 with his Form 1040 with the income exceeding the 125% of the national poverty guideline.

          2. The bank statement of his business account in the past three months in order to show his self-employed status.

          3. The sponsor's identity document

          Do you think these are sufficient for the application?

            That's about it. But as a non-petitioner joint sponsor, the father-in-law must include copy of his U.S. birth cert or U.S. passport ID page or Green Card. I don't know what you mean by "identity document," as that's too generic a description to fit U.S. documents.

            A copy of his local business license or permit might be a good idea, also.
