So, we understood that because my husband is a US citizen who has returned to live in the US, and I am his wife and the mother of his child (who is dual), that we could file I130 and I485 concurrently, from within the US.
When I crossed the Can/US border (to "move" with my son and come meet my husband in our new home), the officer was very firm about how I am JUST A VISITOR- not moving, and I would have to go back to Canada before I could move here. I do understand that I am technically a visitor who cannot stay over 6 months, but I thought that I was allowed to file for immigration once I'm within the US, as an immediate family member...etc?
I am sorry. Can someone lay it out really clearly for me? Or direct me to a webpage that will? Should I use a Canadian address on my I485 form (ie not the US home I share with my husband)? And then leave the country when I'm approved so I can come back in?
I really thought we were doing this right, but the border officer has me freaking out. I don't want to be here illegally and have to leave my husband or my baby...?
