  • MTR I-485 Please help!!

    I moved to US on a H4 visa in 2003 (my dad got a H1B). My lawyer got caught doing fraud which resulted in thorough checking of all her cases. My dad's I-140 got denied because of bachelors being incompatible with the American degree (Indian degree which was 11+4 instead of the usually 12+4). Since the I-140 was denied, his I-485 was denied as well. My I-485 is denied as well since I am the dependent. I have filed for a MTR since I needed an EAD to get my license renewed. I know it will get rejected as well, so do I have any other option? Can I go on a F-1 visa based on a pending MTR?

    Any help in this regard will be appreciated. I have been to a lot of lawyers but most have said that there is nothing that can be done or the ones who say they might get something done ask for a whole lot of money which I can't afford. I have bad luck with lawyers as I have already suffered with my first lawyer, so I don't know if I can trust them any more.

    Many attorneys love to see this type of case come their way, because they can justify asking for a big retainer, but can't justify making any guarantees of the outcome.

    It is common practice when Federal agencies suspect fraud with professionals (immigration, tax, etc.) that they try to review a sample, if not all, client cases which have been worked by the subject being investigated. Many innocent clients end up being penalized by the trouble the "professionals" has caused themselves.

    In my opinion, you should probably disassociate yourself with any procedure or benefit resulting from any involvement with the attorney in question, and start over completely.

      The lawyer is in jail now or probably deported (she was on green card), so we aren't associated with that attorney anymore. Our case has been screwed for a while now, and i don't know if I can start over again because I am a student and technically out of status (maybe with the MTR pending I might be in status). I am trying to get into medical school but I need a green card for that. So can I still go on another status based on a MTR pending? I know it doesn't give me a green card, but my first priority is to stay in status.
