  • AOS Needing urgent attention

    Here there i am curious about this particular matter which is at hand and I would appreciate any information that can be shared on this matter.

    I am married to an USC 21 months now I came here legally but is now out of status and I would like to file my documents but within the last four weeks ago we were going through a lot of argument in our marriage such that we couldn't even pay rent. We got out of the house that we were living in and moved in with different personnel in different houses.

    While doing so my wife called in for assistance for food stamp and told them she was separated from me and have no where to live so right now she is on stamps but we are now back together because the person who is going to stand affidavits of support is giving me some financial aid which allows us to rent somewhere.

    My question is what implication will all of this have on us filing for AOS my wife is also planning to give up the assistance that she is getting also and would it be better to get an P.O Box address for my AOS mailing address since it will be more stable so that we can direct our mail there rather than using the motel address.

    Do you think this will be a barrier in my way in-terms of getting my greencard.

    All that you are describing implies an unstable, perhaps even dysfunctional lifestyle. From what you describe, putting your visa conversion and Adjustment paperwork together may be a real challenge, with problems in your lifestyle that might be reflected in the paperwork and interview.

    My advice is to get your relationship together, make sure your U.S. citizen spouse has a job, and you have a physical address that you can call your own, all before you get an immigrant medical exam (about $300), and pay the visa conversion fees ($420 + $1,070).

      Thank you for your advice I will take heed, also do you think by her getting that food stamp assistance that it will spark any problem later pertaining to my AOS ?

      She does work but its self employed and at times things get slow and another it picks up. we are living together now but its at an extended stay where its more economical than renting a house. Again thanks for the insight I really appreciate it.

        No, the Food Stamps shouldn't be an issue.
