Help! Is it better to stay or to leave my home address? Complicated!

  • Help! Is it better to stay or to leave my home address? Complicated!

    Hi, i need help.
    I married with my wife for 5 years. She just got her citizenship last week.
    For the past 5 years, for some reason, i havent been able to file any adjustment of status, or any similar form.

    I am going to file i485, i130, and i765 within a week.
    I have been living with her for the past 6 years.
    I live in my current address for over 4 years already.
    However, the landlady is crazy, we really can not stand her anymore. The Landlady lives on 2nd floor.
    We really want to move out.
    Currently, i am overstay my F1 visa.
    So, the question is, should I just wait for couple more months, or can I move out this month?
    If I move out this month, will that make it harder for me to submit a proof that i lives with my wife for the past 6 years?

      The I-130 is submitted with your wife as petitioner. If she doesn't share the same address as you, you will probably have problems at the Adjustment of Status interview when the review will look for evidence that you are not cohabitating.

        Thanks for the reply.
        Me and my wife have been living together in this current address for the past 4 years
        Me and my wife want move out together to another address.
        Should we just wait until i130 being approved and then move out, which will take couple more months, or is it okay to move out now and file the form with the new address?

          Submit an online address change, referencing your I-130 receipt number, and call the USCIS hotline as a followup to make sure your new address is attached to your petition case.

          If you have not submitted your I-130 and I-485 yet (together), move and submit your forms using the new address.

            So, if i decided to move out soon, i should not have a problem proofing that I lives with my wife for the past 4 years on the current address right? I just dont want to make it looks like a fraud.
