  • Request for inicial evidence i-485

    I have my i-130 approved, ans now I send my petition for adjustment of status i-485. My husband is an american citizen, he is my sponsor on this petition.
    They request supporting tax documentation (w2, 1099 etc) which we have, no problem there.
    But they are also saying we do not meet the 125% of the poverty line on the affidavit of support. We have check on the uscis website and we are over that poverty line, Imcalled the costumer service and they say the numbers suppouse to work for the household size.
    I'm not sure if we can send a letter showing the guidelines and resubmutting our form i-864. The costumer service wasn't very helpful they just tell us to get a lawyer. We fill out our forms, and maybe this particular i-864 was wrong, we also send our tax transcripts for the last 3 year.
    What should we do? I don't want my case to be denied.

    What about a co-sponsor?
    He will have to file an affidavit of support I-864 (or I-864A) as well.

      Read the RFE verbiage over very carefully. Try to identify the specific fields from your I-864 that caused the confusion. Have a third party familiar with the sponsorship requirements review what you sent thoroughly. If you cannot identify what caused the problem (completing I-864 incorrectly, lack of proof of sustainable income), a "clean" co-sponsor can fix this.

      Don't send back the same package you used before; don't try to negotiate or argue by mail...it won't work.
