  • I-485 denial

My I-485 denial due to the my physical exam result was open when summited. What is the next step I need to do?

  • #2
Can you clarify the reason for denial? Do you mean that you did not provide an immigrant medical exam and did not respond to a Request for Evidence for an immigrant medical exam? Or was there something wrong with the medical exam.

      Later from officer stated .
The medical examination that was submitted was not provided in a sealed envelope as required. Because you did not provide the requested evident,USCIS consider your application abandon and therefore, denies it.

Normally you would have been sent a "Request of Evidence" before denial. If they flat out denied you without a warning and opportunity to send the medical exam correctly, that is very unusual.

If, on the hand, you were sent a "Request for Evidence," which would have clearly stated the need for an immigrant medical exam in a sealed envelope, and you did not send a completed I-693 in a sealed envelope as requested, you were at fault and a denial was to be expected.

You can submit an I-290B, Notice of Appeal or Motion, for a $630 fee, if you can provide evidence that the decision was incorrect.

On the other hand, you can submit a new I-495 for $1,070 fee and make sure the package has the required evidence.

This such a BS I know better not to open the exam as it was sealed from the doctor. I did not get any request for the evident. They flat out denied my case. Now I have to pay $630 to have it re-open.

If your I-485 procedure does not require a fee, then resubmit the package.

I just request from another copy from the doctor in a sealed envelope. My exam was last year 11/11/13. It should be good for a year correct? So re-submit I-485 would be my best option since it free for refugee case.

I've seen a few applicants request copies of previously-delivered exam results for free (as a courtesy) or for a minor paperwork fee ($20). The specific reason I can recall was because Adjustment was denied, for a reason unrelated to the medical exam, and the applicant had to resubmit a new Adjustment package.
