The I-797 Notices of Action, indicating receipt of your fees and the three base forms (I-485, I-765, I-131) take about 3 weeks to show up. DMV agencies do not consistently accept receipt NOA's as proof of eligibility for a driver's license. This practice may vary by State or even DMV employee. I heard of a Cleveland, Ohio, DMV employee accepting a form I-797 that was actually a "rejection notice," for lack of proper fee, as proof of driver's license eligibility. This means that training of the employees seems to have focused on a form number, but not what the form (I-797) was issued for (receipt, approval, rejection, etc.).

Right, the approved I-130 does not qualify anyone to apply for a driver's license.

On the other hand, the receipt Notice of Action for the I-485 "may" satisfy your DMV requirement of your eliibility to apply for a driver's license. This rule, however, will vary by state, as DMV agencies are state-specific. In California, the receipt NOA would not meet this requirement; one would need the Work Authorization or Green Card.

It's all "relative," no pun intended. I'm talking to a Filipina this morning who wants to petition her sister. Sibling visa for Filipinos take 23 years to be eligible for visas.

Spousal petitions to bring the spouse to the U.S. from abroad have averaged 8-12 months for the last few years.

A conversion while in the U.S. is still about 6 months, from submittal to Adjustment interview.

The only thing different these days is that the National Visa Center has lengthened its average processing time from a few weeks to 3 months and more lately.

If you have already been processed by the National Visa Center for an immigrant visa (CR-1) , didn't you get interviewed at your home country?

If you were petitioned while in the U.S., then had your paperwork processed by the NVC, you wasted time and money for NVC step, which wasn't needed if adjusted in the U.S.

On the other hand, if you came to the U.S. on a K1 (fiancee) visa, your NVC step didn't entail an NVC approval, simply a passthru to your home country.

Please clarify the visa type which got you into the U.S.

                            Adrienn,

I think you are confused. If one is being processed in the U.S., you disregard the NVC notices altogether and proceed with I-485 submittal, along with a copy of your I-130 approval notice.
